Softwood lumber duty rates fall on paper, but cash deposits mostly don't move

A NAFTA panel ending a long fight over the 2017 countervailing duty determination cut most company rates. Commerce says the five named producers' current cash deposits stay put, and the notice does not say what that means for the original rates.

The lowered rates mostly don't change what importers post

Commerce's notice, published November 3, 2026, amends the 2017 countervailing duty determination on Canadian softwood lumber after a NAFTA binational panel affirmed Commerce's Second Remand Determination on October 5, 2026. Four of the five named companies get lower rates. Tolko falls from 14.85 to 11.01 percent, West Fraser from 17.99 to 16.73, Resolute from 14.70 to 13.90, and J.D. Irving from 3.34 to 2.96. Canfor is the odd entry. The notice's table lists its original rate as 13.24 and its new rate as 12.49, but the dossier's summary of the same table describes the change as 11 to 12.49, and that appears to be a footnote marker read as part of the figure. The table values show a decrease, and the discrepancy should be checked against the printed document. 'All others' falls from 14.19 to 12.80. [S1]

The practical sting is in the cash deposit paragraph. Commerce says Canfor, J.D. Irving, Resolute, Tolko and West Fraser have superseding cash deposit rates from later administrative reviews, so this notice does not affect what they currently post. Only companies without a superseding rate will get revised instructions to U.S. Customs and Border Protection, and those instructions have not been published. Whether the lower original rates matter to entries from earlier periods is not addressed in the supplied text. [S1]

A six-year path to a notice that says 'not in harmony'

The timeline is long. Commerce published its final determination on November 8, 2017. The panel ruled March 6, 2024 (one footnote cites the decision as dated May 6, 2024, a mismatch the notice leaves unexplained). Commerce issued its first remand redetermination December 17, 2024, the panel remanded again March 6, 2026, Commerce answered June 17, and the panel affirmed October 5. The Secretariat issued its Notice of Final Panel Action October 19. The notice is dated October 28 and applies from October 29. [S1]

Commerce calls the panel result 'not in harmony' with its original determination, which is required publication under the Timken doctrine as the notice describes it. In plain terms, the agency is obliged to announce that the panel's decision departs from its own. Here the panel affirmed the redetermination, so the disharmony is with the original 2017 rates, not with Commerce's latest position. [S1]

Other November notices are different proceedings

The same Federal Register week carried unrelated trade-remedy items, which should not be read as part of the lumber action. On November 2, Commerce initiated sunset reviews for orders on mobile access equipment, potassium permanganate and polyester textured yarn from four countries, while the ITC instituted matching reviews. The ITC response deadline is December 2, 2026, with comments on adequacy due January 12, 2027. Commerce's rules require a domestic notice of intent to participate within 15 days of publication, or the order is revoked. [S3][S5][S6]

A separate section 337 patent case on extrusion-coated magnet wire was instituted October 29 on an Essex Solutions complaint, naming Wellascent entities as respondents. That is an intellectual property remedy, not an AD/CVD order, and the complainants seek exclusion and cease-and-desist orders. [S2]

What remains unresolved

The notice does not give the new cash deposit rate for companies lacking a superseding rate, the entries affected, or whether liquidation suspension ends. Readers should wait for CBP instructions and check Canfor's figures against the printed table. [S1]

What this analysis adds

Separates the lumber notice's rate table from its narrower cash-deposit effect, flags a Canfor figure and panel-date discrepancy, and keeps unrelated sunset and section 337 notices distinct.

Limits of the evidence

Based on excerpted Federal Register text; the lumber notice is truncated, so footnotes and later sections are unseen. No CBP instructions, entry data or financial effects are in the dossier.
